Billy reads and explains the classic case of Adams v Bullock, 125 N.E. 93 (1919), from Court of Appeals of New York, where a boy was injured by swinging a metal wire into electrical trolley wires. We learn that, because the trolley company had taken reasonable precautions to avoid foreseeable dangers, and nobody could have predicted the injury, it did not owe a duty of care to protect the boy from injury, and it could not be held liable.

Laying Down the Law, Season 2, Episode 2  “A Shocking Story” with Cathy Eller and Toni Senatore*

*This episode is sponsored by the Offices of Attorney Steve Gorman, THE LAW SHARK

First, Billy reads and explains the classic case of Adams v Bullock, 125 N.E. 93 (1919), from Court of Appeals of New York**, where a boy was injured by swinging a metal wire into electrical trolley wires.  We learn that, because the trolley company had taken reasonable precautions to avoid foreseeable dangers, and nobody could have predicted the injury, it did not owe a duty of care to protect the boy from injury, and it could not be held liable..

Inspired by the facts of the case, Billy, Toni and Cathy improvise a 1919 street gang which turns into a superhero origin story.

Finally, we learn more about Cathy and Toni, and have a special visit from “The Future Fairy.”

** NERD ALERT: in the episode, Billy incorrectly states that Justice Cardozo was not a Supreme Court justice, but Billy is, as usual, wrong. Legal history scholars will recall Cardozo was one of the liberal "Three Musketeers," along with Brandeis and Stone, on SCOTUS from 1932 until his death in 1938.
